Technology Denmark (TD) bestræber sig altid på at sikre og værne om dine oplysninger. Herunder kan du læse nærmere om behandlingen af dine personlige oplysninger, hvad formålet med behandlingen er samt hvilke rettigheder, du besidder, når dine personoplysninger bliver behandlet.

Formål med behandling af personoplysninger

Dine billeder og personoplysninger bliver opbevaret og behandlet af TD for at udføre arbejdet i forbindelse med TD’s formålsparagraffer. Dine billeder, som vi har fotograferet, og de oplysninger, som du har givet os, bliver behandlet i overensstemmelse med persondatalovgivningen. Er der tale om portrætfotografering, eller fotografering, der kræver samtykke, indhenter vi samtykke fra de personer, der er på billederne. Vi indgår databehandleraftaler med de firmaer, vi benytter. Hvad enten det er virksomheder, som står for billedbehandling, opbevarer vores billeder eller hoster vores hjemmeside. Det gør vi for at sikre, at de også overholder reglerne og principperne om beskyttelse af personoplysninger. I helt særlige tilfælde kan vi være tvunget af anden lovgivning til at videregive oplysninger til myndigheder, forsikringsselskaber, banker eller andre, såfremt de kan fremvise legitim adgang til oplysningerne. TD har ophavsretten til de billeder, vi tager.

Kategorier af personoplysninger og deres kilde

Der indsamles kontaktoplysninger i form af navn, adresse, e-mail og tilknyttet uddannelsesinstitution. Der indsamles alene personoplysninger, som den fotograferede selv har afgivet eller som den virksomhed, TD laver aftaler med, oplyser. TD opbevarer og anvender kun de oplysninger om dig, der er nødvendige for at kunne udføre vores opgaver og efterleve myndigheders eller andres krav om dokumentation..

Modtagere af personoplysninger

Personoplysninger, der er afgivet i form af kontaktoplysninger, videregives ikke til anden aktør, medmindre dette er særskilt aftalt med dig eller det er nødvendigt som følge af andres legitime krav, se ovenfor om myndigheder m.fl.

Opbevaring af oplysninger

De portrætter og billeder, der kræves samtykke til, og som TD har ophavsretten til, opbevares i op til 5 år i vores arkiv og slettes derefter permanent.

Adgang til dine oplysninger

Du vil altid på forhånd blive informeret, når dine oplysninger vil blive behandlet og fotografier af dig blive opbevaret. Hvis du ved eller har en formodning om, at TD behandler personoplysninger om dig, har du en række rettigheder i forhold til behandlingen. Disse rettigheder er listet herunder. Hvis du vil vælge at gøre brug af dine rettigheder, skal du henvende dig via e-mail til info@technologydenmark.dk. Ved henvendelse vil vi indledningsvist sikre os, at du er den reelle ejer til oplysningerne eller billeder, før du kan udøve dine rettigheder. En henvendelse vil blive behandlet inden for rimelig tid og senest 4 uger efter modtagelsen. Såfremt det vil tage længere tid at behandle din henvendelse, vil du blive informeret herom.

Retten til indsigt

Du har ret til at bede om indsigt i de personoplysninger, vi behandler om dig. Dette gælder både hvilke oplysninger og billeder, som opbevares af os, og hvad de er anvendt til. Ved anmodning om indsigt i hvilke fotografier, der opbevares af dig, vil du få adgang til at se billederne digitalt online. Du har som udgangspunkt ikke ret til at modtage fysiske eksemplarer af billederne eller modtage billederne digitalt i høj opløsning.

Retten til at gøre indsigelse

Du har ret til at gøre indsigelse, hvis du er uenig i vores behandling af dine personoplysninger. Dette kan være, hvis du mener, at behandlingen ikke er i overensstemmelse med de formål, som er beskrevet i denne privatlivspolitik eller et givet samtykke. Vi vil i hvert enkelt tilfælde vurdere om din indsigelse er berettiget.

Retten til at bede om berigtigelse

Du har ret til at få rettet ukorrekte oplysninger. Retten gælder for faktuelt ukorrekte oplysninger og for ufuldstændige oplysninger, såfremt dette har betydning for behandlingen.

Retten til Dataportabilitet

Du har ret til at få udleveret dine oplysninger i et teknisk læsbart format. Bemærk, at der alene er tale om de personoplysninger, du selv har givet til mig. Hvis du vil have dine billeder udleveret, må du kun anvende billederne til privat brug, da vi har ophavsretten til billederne. Hvis du vil anvende billeder kommercielt eller til offentliggørelse, skal du indhente tilladelse hos os.

Retten til at bede om sletning

Du har ret til at bede om, at dine oplysninger og billeder bliver slettet. Denne ret er gældende, såfremt oplysningerne ikke længere er nødvendige til at opfylde formålene, hvis du tilbagekalder dit samtykke eller hvis behandlingen er ulovlig. Denne rettighed er ikke endegyldig, da visse data ikke kan slettes på grund af anden lovgivning, eller hvis formål giver os ret til at opbevare personoplysninger og billeder. Såfremt behandlingen er sket på grund af en legitim interesse og ikke et givet samtykke, så vil det først vurderes om den legitime interesse vejer tungere end dit ønske om sletning.

Retten til at trække samtykke tilbage

Når vi tager fotos af personer, vil dette typisk være baseret på et samtykke, og du vil derfor på et hvilket som helst tidspunkt kunne trække dit samtykke tilbage. Vi er kun berettiget til at beholde oplysninger, der skal bruges som dokumentation over for myndigheder, forsikringsselskaber, bank eller andre, der har en legitim adgang til oplysningerne.

Retten til at klage

Du er altid velkommen til at henvende dig til os, hvis du har spørgsmål eller ønsker at klage over vores behandling af dine personoplysninger. Du har dog også altid ret til at klage til Datatilsynet, som er den myndighed, der forestår overholdesen af lovgivningen om beskyttelse af personoplysninger. Technology Denmark (TD) strives to always ensure the safety of your data. Below you can read further about the handling of your personal data, the purpose of it, as well as which rights you possess when your personal data is being handled.

Purpose of handling personal data

Your images and personal data are stored and handled by TD to carry out work in relation to TD’s purpose. Your images which we have taken, and the data you have given us, is handled in compliance with the privacy law. In case of portrait images or photographing, that demands consent, we require a declaration of consent from those visible in the images. We include agreements of data handling with the companies we cooperate with, whether it is the companies responsible for image handling or the host of our website. It is done to ensure, that they also follow the rules and principals for protecting personal data. In very special cases, we may be compelled by other legislation to pass on data to authorities, insurance
companies, banks, or others, if they can demonstrate a legitimate access to the information. TD has copyright to the images we take.

Personal data categories and their source

Contact information is collected in the form of name, address, e-mail, and information related to the education. The only data collected is provided by the photographed person, or informed about by the company, with whom TD has made an agreement. TD stores and uses only the data of you that is necessary to carry out the tasks, and to comply with authorities’ and others’ requirements for the documentation.

Recipients of personal data

Personal data, that is provided in the form of contact information, is not disclosed to other parties, unless there is a separate agreement with you, or it is necessary to follow legitimate requirements of others. See above about authorities, etc.

Storing of personal data

The portraits and images which require consent, and which TD has copyright to, are stored up to 5 years in our archive, and afterwards deleted permanently.

Access to your personal data

You will always be informed in advance, when your data will be handled, and when images of you will be stored. If you know or have an assumption, that TD handles your data, you have a list of rights in relation to the handling. These rights are listed below. If you choose to use any of your rights, you need to contact us via e-mail at info@technologydenmark.dk. Upon request, we will initially ensure, that you are the real owner of the data or images before you can access your rights to the data. A request will be handled within a reasonable amount of time, and latest 4 weeks after obtaining it. In case it takes longer to handle your request, you will be informed.

Right to insight

You have the right to ask insight to the personal data we handle of you. It applies to both the data and images stored by us, and to what they are used for. Upon request of insight to which images of you are stored, will you get an access to see the images digitally online. You do not have the right to receive physical examples of the images, or to receive the images digitally in high resolution.

Right to oppose

You have the right to oppose if you disagree with the handling of your personal data. It is possible, that in your opinion the data handling does not comply with the purpose described in this privacy policy or with the given consent. In either situation we will assess if your opposition is justified.

Right to dataportability

You have the right to receive your data in a technical, readable format. Note, that it only applies to the data you have provided. If you want to have your images handed out, you may only use the images privately, since we have the copyright to the images. If you want to use images commercially or publicly, you need the permission from us.

Right to withdraw consent

When we take images of people, it will typically be based on consent, and therefore you can at any given point in time withdraw your consent. We are only justified to handle data that is going to be used to documentation for authorities, insurance companies, banks, or others who have legitimate access to the data.

Right to complain

You are always welcome contact us, if you have any questions or wishes to complain about our handling of your personal data. You have also the right to complain to Datatilsynet (The Danish Data Protection Agency), which is the authority responsible for the compliance of the legislation to protect personal data.
